Highlights
  • State Consumer Disputes Redressal Commission, Chandigarh
  • Refund of ₹10,05,100 with 9% interest; ₹75,000 compensation; ₹35,000 costs
  • ₹44 lakh cash payment claim rejected for lack of documentary proof
  • Possession had been promised by 31 May 2025

The State Consumer Disputes Redressal Commission in Chandigarh has ordered Sushma Buildtech Limited to refund ₹10,05,100 to a Dera Bassi couple who booked a flat in the developer's Zirakpur project, The Tribune reported on 16 June 2026.

The case

Vivek Gupta and his wife booked a second-floor flat under an agreement of sale dated 19 February 2025. The agreement value, including taxes, was ₹58,75,120, and possession was promised by 31 May 2025. The couple said they received neither possession nor a refund.

They told the commission they had paid ₹54,05,100: ₹44 lakh in cash and ₹10,05,100 by bank transfer. The builder admitted receiving only the bank transfer.

The order

The commission accepted the ₹10,05,100 payment as proven and held the ₹44 lakh cash claim unsubstantiated for lack of documentary proof. It ordered:

  • refund of ₹10,05,100 with 9% a year interest from the dates of deposit;
  • ₹75,000 compensation for mental agony and harassment;
  • ₹35,000 litigation costs.

The lesson for buyers

The case shows how much depends on paperwork. Pay through banking channels, insist on a receipt for every payment that names the unit, and keep copies of the agreement and all demand letters. Cash payments that a developer later denies are very hard to recover.
