Punjab RERA restores Zirakpur buyer's cancelled allotment, orders 10% interest for delay
The developer of Sushma Valencia in Nagla village had cancelled the flat over a penalty demand. RERA reversed that and said possession can be offered only after a completion certificate.

- Flat in Sushma Valencia, Nagla village, Zirakpur; price ₹59 lakh, ₹53 lakh paid
- Possession was due on 8 October 2021 and offered on 1 October 2024
- Allotment cancellation set aside; 10% a year interest for delay
- Possession letter only after a completion certificate
The Punjab Real Estate Regulatory Authority has restored the allotment of a homebuyer in Zirakpur whose flat had been cancelled by the developer over a penalty demand, Rozana Spokesman reported on 30 September 2026.
The dispute
The buyer, Vishal Talwar, booked a second-floor flat in the Sushma Valencia project in Nagla village, Zirakpur, under a sale agreement dated 9 July 2019. The flat was priced at ₹59 lakh, of which he had paid ₹53 lakh, including a ₹45 lakh home loan from HDFC.
Possession was due by 8 October 2021 but was offered only on 1 October 2024. According to the report, the developer then demanded further dues of about ₹10 lakh, a penalty (reported as ₹16 lakh in one place and ₹17 lakh in another), and maintenance charges of ₹72,151 for October 2024 to March 2026, and cancelled the allotment. The buyer complained to RERA in December 2024.
What RERA ordered
- The cancellation of the allotment is set aside and the allotment restored.
- The developer must pay interest at 10% a year for the delay in possession.
- A possession letter may be issued only after a completion certificate is obtained from the competent authority.
The report names the developer as Sukhsha Developers in its text, while the project is marketed as Sushma Valencia. We have not seen the order itself; we will add a link to it on the Punjab RERA website once it is available and correct any detail that differs.
What it means for buyers
Buyers facing cancellation after a delayed possession offer should note that RERA looks at the developer's own delay before accepting penalty claims. Keep every payment receipt, the sale agreement and all correspondence; these decide such cases.
