The Himachal Pradesh Real Estate Regulatory Authority (HP RERA) has fined Verma Construction Company a total of ₹6 lakh for not providing covered parking to three flat buyers at Verma Apartments in Upper Malyana, Shimla, Amar Ujala reported on 4 November 2026.

The company is run by Balbir Singh Verma, the BJP MLA from Chopal. A bench of RERA Chairperson RD Dhiman and Member Vidur Mehta passed the order on Tuesday, 3 November.

The complaints

According to the report, the three allottees booked 1,200 sq ft three-bedroom flats in 2016, each paying an advance of ₹5 lakh. They said that under their settlement and agreement they were given parking in the setback area outside the building. A CGI-sheet roof built over those parking slots was later removed.

The company argued that a 2025 settlement was final. It said the sheds in the setback area were removed after the competent authority objected to them.

What RERA decided

The Authority held that the agreements provided for covered parking inside the building, as shown in the approved plan. It ordered the company to:

  • give each of the three allottees covered parking as per the plan within 60 days;
  • deposit the ₹6-lakh penalty in the RERA fund within the same 60 days.

If the order is not followed, action will be taken under Section 63 of the RERA Act, according to the report. Member Vidur Mehta told the paper the order was based on the terms of the sale agreements.

The company's response

Balbir Verma told Amar Ujala that parking outside the apartment had been provided at the request of the three allottees, and that the municipal corporation had objected to the covered parking. He said the order would be challenged before the competent forum.

What it means for buyers

Parking is often promised loosely in hill-town projects where space is tight. This order shows RERA reading the sale agreement and the approved building plan together. Before booking, buyers should check that the parking promised in the agreement is actually marked on the sanctioned plan. You can search a registered project on the HP RERA website. This is general information, not legal advice. The order can be appealed.
